"To accelerate the PPP potential, the dismantling of legal obstacles is of key importance. The parties agree on this. An important step in this direction was undertaken with the new act to accelerate Public Private Partnerships and for the improvement of basic legal conditions for Public Private Partnerships, passed by the German Parliament on June 30, 2005. With this law, obstacles and ambiguities in the public procurement law, fees regulation, budget law, tax law and investment law were removed. However, the removal of legal roadblocks for PPP must be understood as a permanent, ongoing task - both by the federal government and by the states because obstacles must also be removed on their level as well."
